Tailoring and Support Plans
Once initial implementation is completed and you have begun using the service. It's very likely you will want additional tailoring or support for your account.
In order to provide timely services we offer these options:
5/10 and 20/30 hour monthly packages for $875/ and $3,000/$4,500, respectively. Monthly packages are for 3 months renewing each month. For clients on 20/30 packages additional service at $150 per hour is available but limited by Code Shoppe's availability. And 5 hour and 10 hour package is $175 per hour. This work is scheduled throughout the month. We do however offer emergency services for those things that just can't wait.
In addition to package hours, Code Shoppe offers emergency service at $250 per hour billed by the minute for work completed during non-holiday weekdays from 8am - 8pm eastern time. Emergency services performed outside these times will be billed at $350 per hour billed by the minute.
Note: The above pricing may change at anytime without notice. However, prices will not change for customers on a support plan.
Accepting/Choosing a Support Plan
You choose a support plan by communicating with your Code Shoppe Account Consultant to discuss your specific needs then a simple email with desired monthly package and a note that you accept the terms of service listed below is all that's needed.
Training, Support and Tailoring Service Terms
We appreciate the opportunity to provide you with training, support, and tailoring services. To ensure a complete understanding between us, these terms describe the scope and limitations of the services we will provide in this capacity.
Who/what we are
Code Red by Code Shoppe ("the service") is a software as a service (SaaS) that you subscribe to on a month to month basis with no extended contract. Code Shoppe a division of LaCrews Bookkeeping of Virginia, LLC (“Code Shoppe”) is the owner of CodeShoppe.net and the service. The service is inclusive of the website http://www.codeshoppe.net
, it's subdomains, other domains under Code Shoppe's control, and any other software/tools downloaded from the Code Shoppe website.
What We’ll Do
We will provide training, support and tailoring services, as needed, to facilitate your implementation of the service. These services may be provided at our offices via the internet, remote access, telephone, or email in addition to in-person meeting(s). Travel expenses will apply to in-person meetings. These services will be provided on an hourly basis with time rounded to the nearest minute. Tasks will be initiated through email. Assistance requested by all your officers &/or employees will be addressed. From time to time you may require a time quote. For these situations a separate scoping and approval process may be needed.
Code Shoppe agrees to hold any and all information related to your business in confidence unless we are compelled to comply with a court order.
So you can get the type of support you need, our support plans are designed to be flexible. When you agree to a specific plan, other than pay as you go, you are agreeing to a 3 month term with an obligation to use or be billed for a specified minimum number of service hours per month. During the course of this 3 month term you will be billed each month. At each monthly interval you will be billed for all service hours performed that month plus any hours to minimum.
You can upgrade your support level at any time by emailing with higher monthly hour level indicated. This will terminate your current support plan and start a new 3 month term with your newly selected plan. Your next monthly billing will be prorated accordingly.
What We Won’t Do
Our work cannot be relied upon to disclose errors, irregularities or illegal acts, including fraud or defalcations that may exist. However, we will inform the appropriate level of management of any such matters that come to our attention, unless they are clearly inconsequential. We will make no attempt to adjust the records to reflect Generally Accepted Accounting Principles or to reflect proper tax record keeping. We will make no audit or other verification of the data you submit. We may provide reports that contain portions of financial information; these reports are for internal management use only. We will not provide any financial statements and will not perform any compilation, review or audit of any of the financial information. We do not at any time provide legal services of any type. We have not been requested to discover errors, misrepresentations, fraud, illegal acts, or theft. Therefore, have not included any procedures designed or intended to discover such acts, and you agree we have no responsibility to do so.
Without limitation, we are not responsible, nor liable, for delays, loss, or damage of goods and services due to or resulting from, but not limited to, platform issues, server/ISP issues, acts of God, acts of war, civil unrest, insurrection, strikes or other labor activities, criminal or terrorist activities of any kind or the threat thereof.
The entire risk as to the quality and performance of the service is with you. We do not warrant that the functions contained in the service or a finished task will meet the client's requirements or that the operation of the service or specific application will be uninterrupted or error-free. In no event will Code Shoppe be liable to you or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate the service, even if the service has been advised of the possibility of such damages. You recognize that Code Shoppe is not writing custom source code to be owned by you, and is instead tailoring a platform for your use. As such, you agree to the following.
- Code Shoppe retains ownership of all tailored configurations created in service.
- The configurations cannot be exported or transferred to a different platform without express written permission from Code Shoppe.
- Portions may be repeated or re-used in other projects and used in the service's standard applications, without your permission.
We must work together to complete all tasks in a timely manner. No guarantees on the final delivery date(s) are made by us. Any dates specified in task requests are to be considered as goals, not guaranteed deadlines.
What We Need from You
Specific tasks are to be requested through email with attachments used as necessary. An email should be used to schedule all telephone meeting(s). All data and supporting documents will be provided by you at your expense.
Code Shoppe office hours are 9:00 a.m. to 5:00 p.m. eastern time, Monday through Friday, except for vacations and major holidays. Messages are usually returned within one business day.
Hardware and Software Warranties
During the course of our relationship, if we recommend a purchase and installation of computer or technological hardware, software, communications, or services by your company, warranties, to the extent they exist, are provided only by the manufacturer/vendor of those computer products.
All work performed to accomplish your tasks, including but not limited to service tailoring, planning and collaboration/communication will be charged at the your prevailing rate and in accordance with your chosen support plan as described in these terms and in the above section "Tailoring and Support Plans".
Billings for training, support, and tailoring services will be invoiced monthly and separate from your monthly subscription bill. Failure to pay these fees in a timely manner may result in your account being deactivated. If your bill exceeds 30 days past due, Code Shoppe reserves the right to cancel your account without notice and/or disable any tailored configuration.
From time to time, you may request time estimates for individual tasks. These estimates are based on experience, an assumption of adequacy of needed resources, internal controls and the degree of assistance of your staff. Should any situation arise that will materially increase these estimate(s), we will advise you immediately. Estimate based tasks will be itemized per service hour instance.
From time to time, you may request a time quote for an individual or group of tasks. In these situations, we will use a scoping and approval process. For quote based tasks you will be billed for the number of service hours quoted regardless of hours expended and service hours will not be itemized per instance. If a quoted task overlaps a monthly billing period, you will be billed for a percentage of the quoted service hours in each monthly billing period.
Refusal of Service
Code Shoppe reserves the right to refuse service to anyone for any reason at any time.
Changes to These Terms
Code Shoppe reserves the right to update and change these Terms from time to time without notice.
